@mitu Copied those files over and now boots up BUT Emulation station does not detect anything not even a keyboard so I can' get past that to do the update

If you don't have WiFi, yes.

It's right in the RetroPie's menus, though you can just use the name (
retropie
orretropie.local
) instead. -
@mitu ok won't be able to access wifi with PI as I can't type password in etc.

With the same commands as before - using
apt

@mitu Done that typed both Sudo apt-get and sudo apt update but just get a timeout after 15secs

Looks like WinSCP doesn't like how long it takes for the command to complete. Use Putty instead to login and run the upgrade commands and - after the upgrade is finished - reboot by entering
sudo reboot
. -
@mitu ok with putty get the normal pi terminal, do I need to do anything to allow the pi internet connection through laptop?
Looks like it has no internet access lots of failures

@mitu Finally got it working ok with your help (THANK YOU), full upgrade using Putty worked although my laptop crashed and corrupted the SD card at around 80% of update and had to reflash it and start all over again.
But copying the two files across, then updating via putty worked in short.
