Why would it matter who he is? He knows how to write some code, so he gets special dispensation? That's in the "spirit of the RetroPie project and the ethos of Open Source Software"?
Let's say you're all correct; the OP had no business purchasing anything off of eBay. Presumed. A simple response still would have been better than what was provided.
I find it sad that every other poster to this thread would prefer to make a fellow human feel bad and/or inferior. Great ethos!

After pointing out that a page making a claim doesn't make it a Law, I'll also point out that in the USA and GB (and likely other jurisdictions), offering Legal advice is illegal unless the one offering it is a lawyer.
Informing a person that a certain act is illegal based on public information is not considered “legal advice” Herb (retropie’s co-creator) is citing the non-commercial licenses of Retroarch, Libretro, the Retropie Setup Script and most of the emulators included on the image which fall under GPL, which is a very real and enforceable legal license.
Telling somebody “selling retropie is illegal” is about as illegal as telling somebody “running a stop sign is illegal”
An example of “legal advice” would be telling somebody “hey party A, you should sue party B because I read on the internet that you have legal ground to do so” - though in actuallity, this would never be enforced by the US courts.
It’s best to get your context straight to avoid sounding ignorant.

Well, hold on now. That's not really how it went down. Scroll back up and you will see that the first response by @herb_fargus was simple and went straight to the point. "Ask the seller," followed by pointing out that the sale was illegal.
The poster, having joined the forum obviously ignored the required READ THIS FIRST item number 5 which clearly states that third party images cannot be supported, and went ahead and posted this question anyway. Regardless of who Herb happens to be, his response was on point and it might have come from any one of us.
The very next post by @Darksavior clarified that it is possible the OP has a version conflict--something only the seller can confirm and/or troubleshoot, and added that a fresh, official image is the supportable starting place--a fact that even you corroborated in your first response--although you questioned the legality point, turning what was at first reasonable advice into an argument about the software licenses.
The way I see it, we did have a simple response, but that changed when you jumped in and accused Herb and Darksavior of adding more noise than signal. Seems to me, the "noise" started with your post which did not offer more technical "signal" at all, you just repeated Darksavior's advice and picked a fight about who can do what from a legal perspective.
